1. Who and what is addressed in this Privacy Policy?

"Alpha7X" or the "Company" refers to Alpha7X by Theoris Software. In this privacy policy, "We" or "Us", refers to Alpha7X. The " Alpha7X Platform" refers to this website, software and content provided by Alpha7X. The Alpha7X Platform and its content is designed to comply with U.S. laws and regulations. "You" or "Your" refers to the person requesting a demo, signing up for our platform, or otherwise using the website accessible through www.alpha7x.com.

Alpha7X’s Privacy Policy (this “Privacy Policy”) pertains to the information that We collect via the Alpha7X Platform or by other means when You use the Alpha7X Platform. This Privacy Policy is a part of the Alpha7X Platform End-User License Agreement Terms and Conditions available in our platform agreement at the point of client registration. When you accept the Terms, you also accept this Privacy Policy. You accept the Terms of this license by signing up for the Alpha7X Platform. Some components of the Alpha7X Platform may be available to You without signing up or selecting "I Agree." If You use only those sections of the Alpha7X Platform, your use or access of those components of the Alpha7X Platform acknowledges your acceptance of this Privacy Policy. You accept it both on behalf of yourself personally, and on behalf of your employer provided that the Alpha7X Platform is being used as part of your job, or on behalf of your employer. Capitalized terms that are not specifically defined in this Privacy Policy will have the meaning described in the Terms.

This Privacy Policy applies to information We ask You to provide to the Alpha7X Platform. Any unsolicited information provided by You, such as by sending an email or a message via social media outlets to US prior to registering, is non-confidential and will not be treated as private information. You grant Alpha7X a nonexclusive, royalty-free, worldwide, perpetual, irrevocable, transferable, and fully sublicensable right to use, copy, make derivatives from, and publish the unsolicited information for any lawful purpose and without limitation or attribution when You provide unsolicited information to Us.

To alert You further concerning Alpha7X’s privacy practices, We may also collect, use, or provide Your Personal Information (defined below) as disclosed in short "Privacy Notices" posted on the Alpha7X website infrequently, provided to You by email, or while You are signed into the Alpha7X Platform. Such Privacy Notices are additional, and not in lieu of this Privacy Policy. To the extent they contrast from this Privacy Policy, they will apply only to the specific Personal Information precisely discussed in the Privacy Notice. This Privacy Policy is intended to be construed together with any such Privacy Notice.

2. Collected information

2.1 Personal

"Personal Information" refers to identifiable information about an individual collected from that individual by Alpha7X through the Alpha7X Platform or by other means such as, Your voluntary submission of Personal Information to Us via the completion of a registration form on our website or via an email You send to Us. We may request or collect specific types of Personal Information including, without limitation, information about you in the following general categories:

Identification : When you seek to use the Alpha7X Platform by registering as an End-user, We will ask for Your name, email address, telephone number, and company name and Personal Information that may also include, without limitation, Your company address, telephone number, e-mail address, website address, copies of your professional licenses, and other relevant information to ascertain your ability to use our platform.
Location : When you use the Alpha7X’s Platform to provide appraisal services, we may collect precise location data about where the services are to be provided and the location of the End-user through the platform. We may also derive your approximate location from your IP address or based on wireless towers or access points that connect to the device.
Appraisal report details: We collect transaction details related to your use of our products, including the type of products requested, date and time the service was provided, amount charged, and other related transaction details.
Usage and Preferences: We collect information about how you and website visitors interact with our products, preferences expressed, and settings chosen. We may use cookies, pixel tags, IP addresses and other technologies that may create and maintain unique identifiers in some circumstances.
Device: We may collect information about your computer device, for example, software and appraisal report file names and versions.
Communication Data: Our Alpha7X Platform facilitates communications between End-users.
System data: When you interact with the Alpha7X Platform, we collect logs, which may include information like device IP address, access dates and times, features or pages viewed, platform crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with the Alpha7X Platform. We use Log Information to help improve the security and functionality of the Alpha7X Platform, including by analyzing how users are using it.

We may collect account information for accounts You use on those third-party sites or social networks if they are connected to Alpha7X. We collect payment card and financial institution information as well, in order to allow Us to collect and distribute payments. We may also collect geo-location data of Your mobile or other device, including, without limitation, GPS-based, Wi-Fi-based, or cell-based location information from time to time. as well as your internet protocol (IP) address, MAC address, or other machine identifiers as you access the Alpha7X Platform or website.

You are required to register yourself to use the Alpha7X Platform. You will be required to provide Us with Personal Information while signing up. Some of the Personal Information that We ask you to provide is mandatory and some is voluntary. Without the mandatory information, you may not be able to use the Alpha7X Platform or experience limitations. We reserve the right to change which sections are and are not required for sign up as We modify and renovate the Alpha7X Platform.

2.2 Accessing and updating End-user personal information

You may update Your Personal Information through the Alpha7X Platform. If you should become aware that your Personal Information with Alpha7X is not complete and accurate, you must promptly update your Personal Information via your account. It is your obligation to ensure that your Personal Information is kept up to date. This is important for many reasons, including allowing institutions to verify your use of the Alpha7X Platform and credit you receive for the work you do through the Alpha7X Platform. We may backup or replicate Personal Information stored through the Alpha7X Platform for disaster recovery or other purposes. Updates to your Personal Information will not necessarily be reflected in such backups or replicated data when you make those updates.

2.3 Third-party sites

Some of Our services may be provided through sites that bear the names or trademarks of Our partners, and that are not under Our control. In addition, the Alpha7X Platform may contain links that take you to other websites that are also not within Our control or pull content from such websites for display on the Alpha7X website. Certain of those other websites may provide products or services to you directly or on Our behalf. We are not responsible for any aspect of other websites, including, without limitation, the privacy practices, products, services, or content of such websites. This Privacy Policy will not apply to other websites or platforms. Your activity and the information that you provide at such other websites will be subject to the privacy policies and other terms and conditions posted on those sites. You are responsible for reviewing those privacy policies and other terms and conditions prior to providing any Personal Information to those sites, regardless of whether you access them in connection with your use of the Alpha7X Platform.

2.4 Age restrictions

The Alpha7X Platform is intended to be used only by persons over 18 years of age and does not intend to collect Personal Information or other information from or about children. You agree to notify Us immediately in writing referencing your Alpha7X account, by mail at Alpha7X, 360 Central Ave, Suite 800, St. Petersburg, FL 33701, or by email at hello@alpha7x.com, if you become aware that We have received information from or about any such individuals. The Alpha7X Platform may collect information intended to verify that you are an adult who is eligible to use the Company's services.

3. How Alpha7X uses provided information

3.1 Use of information

Personal Information that you provide to Us is primarily processed and stored on the servers located within the United States. We may change the location of the servers occasionally, and without prior notice to you. Your Personal Information, however, will continue to be protected in accordance with United States law and this Privacy Policy. In the event of a change of ownership or restructuring of Alpha7X (in whole or in part), any or all Personal Information maintained by Alpha7X may be transferred to another entity, and such entity may then change this Privacy Policy in accordance with the Alpha7X Platform End-user License Agreement Terms and Conditions. Changes of ownership or restructuring may occur without notice to you.

Alpha7X may store and use your Personal Information and, without further notice to you, provide your Personal Information to Alpha7X affiliates or to third parties for Us, Our affiliates or third parties to do any of the following:

support Our intent to provide, maintain and improve functionality of the Alpha7X Platform including, preventing fraud and abuse of our services or the Alpha7X Platform; troubleshooting software bugs and operational problems; conducting data analysis, testing, and research; and monitoring and analyzing usage and activity trends.
provide, maintain, and improve our services and the Alpha7X Platform, including, for example, to facilitate payments, send receipts, provide products and services you requested (and send related information), develop new features, provide customer support to End-users, develop safety features, authenticate End-users, and send product updates and administrative messages.
collect and distribute payments.
provide technical support.
provide access to restricted areas of the Alpha7X Platform.
to send or facilitate communications (i) between an End-user and a Borrower, such as estimated costs of fees, (ii) status of an appraisal report, and (iii) times of submission of an appraisal report.
comply with legal requirements, including, without limitation, governmental orders, civil subpoenas, or discovery requests.
enforce the Terms and Conditions of this Privacy Policy and the End-user License Agreement Terms and Conditions governing use of the Alpha7X Platform including, without limitation, the investigation of potential violations or suspected illegal activities.
protect the rights, property, safety, or security of Alpha7X, any of Our End-users or the public, or to respond to an emergency; or accomplish or attempt to accomplish any other lawful purpose.

Some data, such as without limitation the types of products used and the numbers of users. We receive daily in various parts of the Alpha7X Platform, may be used for statistical, marketing, promotional, or any other lawful purposes. This kind of information is collected in aggregate/statistical form, without identifying any user individually.

3.2 Sharing information.

We also may share your information:

With other End-users to enable them to provide the services you request. For example, we share your name, license, AQPM Score provided by the Alpha7X Platform.
With the public if you submit content in a public forum, such as blog comments, social media posts, or other features of our services or those of End-users that are viewable by the public if you agree not to intentionally share Personal Information in a public forum.
With third parties with whom you choose to let us share information, for example other apps or websites that integrate with our products or services, or those with a service with which we integrate.
With Our affiliated entities that provide services or conduct data processing on our behalf, or for data centralization and/or logistics purposes.
With vendors, consultants, marketing partners, and other service providers who need access to such information to carry out work on Our behalf.
In response to a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise mandatory by, any applicable law, regulation, or legal process.
With law enforcement officials, government authorities, or other third parties if we believe Your actions are inconsistent with our End-user agreements, Terms of Service, or policies, or to protect the rights, property, or safety of Alpha7X or others.
In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.
If we otherwise notify you and you consent to the sharing; and in an aggregated and/or anonymized form which cannot reasonably be used to identify you.

4. Protection your information

Alpha7X has implemented industry-standard measures to protect the security of the Personal Information We collect via the Alpha7X Platform. Regardless of what measures are used to protect Personal Information, no one can guarantee, and We do not guarantee, that your Personal Information is always completely secure. If We determine that your Personal Information was accessed in an improper manner, We will comply with applicable laws as We understand them and will cooperate with internal investigators or law enforcement (including by possibly disclosing your Personal Information to such investigators or law enforcement agencies).

Please understand that you are also responsible for maintaining the confidentiality of your Personal Information to protect it against unauthorized access or use including, without limitation, by ensuring that any credentials that enable access to the Alpha7X Platform use strong passwords and are not shared with any third party. To the maximum extent permitted by applicable law, Alpha7X disclaims any responsibility or liability for any misuse of your Personal Information that results from illegal, improper, malicious, or inappropriate acts or omissions of you or any third party, or from any conduct, other than willful conduct, of Alpha7X.

Alpha7X may retain your Personal Information for as long as you continue to use the Alpha7X Platform, and for as long thereafter as permitted or required by applicable law. If We delete your Personal Information, it may still be contained on backup media or other systems until such times as such media is destroyed or overwritten, or data on such other systems are otherwise deleted.

5. Rights of the End-user

In accordance with the applicable law, Alpha7X will provide you with access to your Personal Information and, as appropriate, the right to intervene in respect of your Personal Information. You may also be entitled to request the deletion of your Personal Information, in which case, if Alpha7X, in its sole discretion, deems deletion of such Personal Information as mandatory or appropriate, Alpha7X may do so, provided, however that such deletion will mean that you may no longer be permitted to engage in certain activities, and may not have any further access to records of your use of the Alpha7X Platform. To exercising your rights, you shall submit a written request to Us in accordance with the applicable law referencing your Alpha7X account, by mail at Alpha7X, 360 Central Ave, Suite 800, St. Petersburg, FL 33701, or by email at hello@alpha7x.com. In addition, if you believe that Alpha7X has not complied with this Privacy Policy with respect to your Personal Information, please submit a sufficiently detailed complaint to Us in any of the foregoing manners. We will promptly investigate your complaint. Thereafter, We will take all measures We deem necessary to remedy the issues outlined in your complaint that We, in Our sole discretion, view as justified. If Alpha7X deletes Personal Information, de-identified summaries, backup copies, and legal records may continue to contain portions of the Personal Information thereafter.

6. End-user options

You can decide if You want to provide Your Personal Information to Alpha7X. If you do not understand and agree to this Privacy Policy DO NOT provide Personal Information to Us. Please note, if you do not provide certain Personal Information, you may not be able to use the entirety of the Alpha7X Platform, or access certain options at the website. If You choose to receive communications regarding special offers, or any other information, We may add your Personal Information to Our email database and use, or direct Our team to use, your Personal Information to communicate with you. You may choose to unsubscribe from receiving such communications by following the unsubscribe directions within Our communications. If you provide Alpha7X with inconsistent privacy preferences, such as, indicating on one occasion that We may provide you with marketing offers and on another occasion that We may not), Alpha7X will endeavor to update your privacy preferences in Alpha7X’s records with your latest preference in a timely manner. But We cannot guarantee how quickly such changes will take effect.

Your sole remedy if you object to any change, is to cease use of the Alpha7X Platform and request deletion of your Personal Information. To the maximum extent permitted by applicable law, the limitations of liability, dispute resolution requirements, disclaimers, and governing law provisions of the Terms will apply to and govern any actual or alleged claims relating to this Privacy Policy.
